Die Suche nach Beweisverboten beschäftigt die Lehre vom Straf- sowie vom Zivilprozessrecht ebenso wie deren Begründung seit Jahrzehnten. Da ausdrückliche Regelungen kaum bestehen, ist dieses Themenfeld mit erheblichen Rechtsunsicherheiten verbunden. In besonderem Ausmaß betrifft dies Beweismittel, die nicht von staatlichen Stellen aufgefunden wurden, sondern eigeninitiativ durch Privatpersonen. Schwierigkeiten bereitet dabei vor allem die Frage, welche Zusammenhänge zwischen einem materiell-rechtlich relevanten Verstoß und einem etwaigen prozessualen Beweisverbot bestehen.
Samuel Strauss completed his law studies at the University of Constance in 2017, having started in 2012. During this time, he worked for several years as a research assistant for Prof. Dr. em. Rudolf Rengier. From 2017 to 2022, he worked as a research assistant at the Chair of German and European Criminal Law and Criminal Procedure, IT Criminal Law and Philosophy of Law of Prof. Dr. Andreas Popp, M.A. at the University of Constance and received his doctorate. In April 2024, he completed his legal training with the second state examination and has since been a habilitation candidate and research assistant at the chair of Prof. Dr. Andreas Popp, M.A. at the University of Constance.
Die Arbeit setzt sich zum Ziel, diese Interdependenzen für das Straf- und das Zivilverfahren vollständig aufzuzeigen. Ausgehend von den Vorschriften des Zivil-, Datenschutz- und Strafrechts werden dabei - entgegen der bislang vorherrschenden Perspektive - prozessuale Einwirkungen von Beweisverboten auf das materielle Recht aufgezeigt. Diese ebnen dann den Weg zu einem dogmatisch stimmigen Beweisverbotskonzept.
